Terms & Conditions for Use of Services

The Terms & Conditions specify the actions permitted to users of our services, including SMS and other services which may be introduced in the future. We reserve the right to modify the policy at any time. All subscribers of our services, directly or indirectly, are required to engage in acceptable use only as per this policy as modified from time to time.

a. Illegal Use

Services may be used only for lawful purposes. Transmission, distribution, or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, violates export control laws, or is anti-national.

b. Subscriber Conduct

Subscribers shall use services only for lawful purposes. They must not post or transmit any material that violates or infringes the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable. Additionally, subscribers shall not use services for advertising or commercial solicitation without express prior approval. Any conduct restricting other subscribers from using services is prohibited. Subscribers are solely liable for copyrighted or proprietary material they upload or transmit without proper authorization.

c. System and Network Security

Any violation of system or network security is prohibited and may result in criminal and civil liability. Examples include unauthorized access or attempts to breach security, unauthorized monitoring, interference with service, forgery of identification, harassment, introduction of viruses or malicious content, or introduction of pornography.

d. Indemnification

Subscribers agree to defend, indemnify, and hold harmless the company, its affiliates, directors, officers, employees, and agents from all claims and expenses arising out of the use of services by the subscriber or any other party.

e. SMS Usage

Subscribers must not transmit unlawful, abusive, defamatory, obscene, pornographic, or indecent messages, or messages that could constitute a criminal offense or give rise to civil liability. Use of sender IDs not owned or managed by the subscriber is prohibited and may lead to account termination and zeroing of credits. Sending unsolicited SMS, including commercial advertising without consent, is explicitly prohibited. The service provider is not liable for the content of SMS messages, delivery delays, or failures caused by technical or routing issues. International SMS sending through SMSC is not permitted without prior authorization.

f. Cost Policy

Subscribers shall pay the agreed amount per SMS plus applicable taxes. Charges apply regardless of delivery delays or message receipt failures, but billing is based on delivery reports. Service taxes currently apply at 14.50%. All payments must be made in Indian Rupees (INR). Bulk SMS should be sent only to national customers, with timing from 9 AM to 9 PM except for time-critical messages. Rates are subject to change based on regulatory fees or inter-operator charges.

g. Refund Policy

We encourage testing our services before purchase. Refunds are not offered once transactions are completed unless previously agreed. If refund is granted, it may take 60 to 90 days, with deductions including monthly fees, SMS charges, and a 15% processing fee.

h. Enforcement

Any violation of these terms by subscribers or their end users, including attempts or indirect violations, may result in actions including termination of services without prior notice. Use of services constitutes acceptance of these terms. If you do not agree with any of these conditions, please do not register or use our services.
